The singer claims he was tricked by software company Activision into letting them use one of the band's most famous songs – Welcome To The Jungle – in Guitar Hero III.

He is also suing over the appearance of ex-bandmate Slash after the game included a character modelled on the guitarist.

Rose claims he only allowed the use of the song in the title after Activision said the game would not have any mention of Slash or his band Velvet Revolver.

In papers filed at Los Angeles Superior Court, Rose accuses the company of "spinning a web of lies and deception" by including both.

He also wants damages because he claims he only licensed the use of the song Sweet Child O' Mine for Guitar Hero II and believes it featured in the promotion of its sequel.

Rose's lawyer Skip Miller said: "The lawsuit is about protecting Guns N' Roses and Welcome To The Jungle, and is about holding Activision accountable for its misuse of these incredibly valuable assets."

Activision said they had "no comment" to make over the legal action.
